Seeing the enthusiasm of all the people on this message board, I would like to request IV Core to co-ordinate rallies in various cities by doing the following:
1. Facilitate a common date for all rallies through consensus
2. Facilitate the development of a common theme through consensus
3. Facilitate an official statement on our position on "employers that abuse the immigration system"
I propose that the San Jose rally organizers should act as advisors to other local chapters since they did a wonderful job organizing the rally.

Hello Friends,
I have utilized AC-21 and moved onto another employer and I will be using my EAD. I have an I-94, from the I-797 of my previous employer, which expires in May 2008.
The question I have is if we have utilized AC-21 can we still live here in US past the I-94 date? Will the stay be considered legal? I ask because as far as I know when a person is on H1B he can not afford to go past the I-94 validity date, does the same apply with an AOS applicant?

Hi,
I have a PERM approval in EB2 with PD Sept 2005, and I140 approval few days back. I will be entering my sixth year in H1 shortly, wanted an advice whether to go for 3 year extension or 1 year extension, are there any demerits of 3 year extension with respect to H1 transfer in case of layoff, etc?

Why are you going to other forums for advice. Those other forums are after making money from traffic and ads. They want you to suffer as long as possible so that they make money. Thanks for your reply. In this specific skills or requirements, we also listed several tools, I let my former employer listed them in their experience letter. Other than that, I really don't how to proof them.
on 2nd req, my opinion would be to submit following related to ur skills.
- certifications earned from industry recognised bodies like PMP or OCP etc.
- any inhouse training recd certificates
- any vendor recd training certificates

My EB2- I140 (INDIA) approved on March 09, 2007. We also have received our EAD last year after filing I-485 in July 2007.
I was checking online status and for my I-140, last updated date shows January 06, 2008. (My EB2 PD is OCT 2006). Can any one explain why the I-140 showing update date of 01/06/2008. The online status says following text :

Current Status: Case approved; approval notice e-mailed.

You are wrong.. all the applications will go to Atlanta processing center irrespective of company's location..
Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...
It's not true that all the cases will got to Atlanta Processing Center ...if any case that has been auidted will be moved to Atlanta Processing Center.

I have H1b Stamped in Jan (Approved in 2007 valid till 1 Oct 2010). My Petioner is well run lawful consultant company (have filed 100+ H1bs since 2001) and he wants me to come to US. My Petioner has in-house as well Client side Projects.
I am having around 8 years of IT experience and Graduate degree in Computer Science. I have worked in past as full time employee with US' No.1 IT Manufacturer in India & have travelled to US twice on Business Visa, I am currently working with a US Bank's Offshore Technology centre in India.
My question is "Is it safe to travel in First week of March 2010 to USA with my H1b stamped in January 2008. In that case What documents I should be carrying along with I-797 Notice of Approval of I-129 Petition.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

To the best of my knowledge, e-filed applications for EAD and AP renewals usually trigger biometrics appointments. If applications for EAD and AP renewals are filed the old-fashioned way, biometric appointments will probably not be required.
With respect to your second question, you must be physically present in the US to file tha application for Advance Parole.
